Agreement to terms

These Terms and Conditions constitute a legally binding agreement made between MyPudsey (“Us”, “We”, “Our”) and You (The visiting user, or company) concerning your access and use of our website https://www.mypudsey.co.uk (“Site”) as well as any other media, channel, mobile website or other application.

By using our website you accept that you have read, understood and agree to be bound by all of these Terms and Conditions. If you do not agree with all of this document, you are expressly prohibited from using Our website and must discontinue use.

Additional Terms and Conditions or documents posted on the Site from time to time are hereby expressly incorporated by reference. We reserve the right, in our discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

Intellectual Property

Unless we otherwise indicate, the Site is property of MyPudsey. This includes all source code, databases, functionality, designs, audio, video, text, photographs and graphics on the Site. Logos and service marks contained are owned or controlled by Us or licensed to Us and are protected by copyright and trademark laws.

Provided you’re eligible to use the Site, we hereby grant a limited license to access and use the Site to view, download and print a copy or portion of the Content to which you have properly gained access. This license is granted solely for your personal, non-commercial use. MyPudsey reserve all other rights not expressly granted to you.

Representations

By using the Site, you represent and warrant:

  1. You have the legal capacity and thereby agree to comply with Our Terms and Conditions.
  2. Your access to the Site is not through automated or non-human means. This means not using a bot, script, spider or otherwise to access the Site and content within.
  3. You will not use the Site for any illegal or unauthorised purpose.

If you provide information that is found to be untrue, inaccurate or incomplete, we reserve the right to suspend your access to the Site.

Prohibited use

You may not access or use our Site for any purpose other than that for which we have made it available. Our Site and content within may not be used for any commercial use except uses specifically approved by Us.

By using our Site, you agree not to:

  1. Retrieve content or information from the Site to create any collection, database or directory without permission from Us.
  2. Interfere or disable any security features of our Site, including features designed to prevent the use or copying of Content.
  3. Disparage or harm, in Our opinion, us and/or the Site
  4. Use information obtained from Our site in order to attack, harass or abuse another person or business.
  5. Harass, intimidate or threaten any of our volunteers involved in providing the content on our Site
  6. Copy or change the Site’s content, features or media.

User contributions

Our Site may provide the facility for you to contribute to or participate in content such as business information, job listings, events, blog posts or otherwise. User contributions are treated as non-confidential and that provided contributions may be viewable by other users of the Site. When contributing to the Site, you represent and warrant that:

  1. You are the creator and owner of any necessary license, right or consent to use contribution you provide to Us.
  2. Any contribution you provide to Us is not false, inaccurate or misleading.
  3. Any contribution you provide to Us is not obscene, graphic, violent, libellous, slanderous or otherwise objectionable (in our opinion)
  4. Any contribution you provide to Us does not disparage, intimidate or abuse any person or business.
  5. Any contribution you provide to Us does not violate any applicable law, regulation or rule.
  6. Any contribution you provide to Us, does not violate any of the terms within this document.

All care has been taken to be as inclusive as possible but the Contribution terms are MyPudsey’s efforts to safeguard against fraud and abuse of the free of charge listing service we offer. We have also considered these terms to be effective in allowing the listings to be manageable, user friendly and to best serve the visitors of our Site.

Business contributions

By providing business information to us you agree to all sections of this Terms and Conditions document, and the following additional requirements:

  1. You/the business must be a registered independent business. (We cannot accept MLM or similar distributors)
  2. You/the business must satisfy at least ONE of the following criteria:
    1. Own or rent business premises that are located within the MyPudsey business map; or
    2. Have registered with the Pudsey Lottery as a business which either sells lottery tickets and/or accepts Pudsey Pounds; or
    3. Are a market trader on either Pudsey Market or Pudsey Produce & Craft Market; or
    4. If you do not own or rent business premises, the business is registered at your home address which is located within the MyPudsey business map AND you provide a service, not direct sale of goods.

Job Listing contributions:

By providing job information to us you agree to all sections of this Terms and Conditions document, and the following additional requirements:

  1. You/the business must be a registered independent business (we cannot accept MLM or similar distributors),
  2. You/the business and the job role must be based within the MyPudsey Business map area or within neighbouring postcodes,
  3. The job role, or awarding of the job role, must not infringe any law enforceable in the UK, whether employment, criminal or otherwise,
  4. The job role must be considered reasonable and genuine by the MyPudsey Committee,
  5. The job listing must not be directly or indirectly discriminatory, unless prescribed in law, and have an application end date

Event contributions:

By providing event information to us you agree to all sections of this Terms and Conditions document, and the following additional requirements:

  1. The event must be in Pudsey or the surrounding area,
  2. The event must be open to the general public, whether entry is dependent on an entry fee or not,
  3. The event holder and/or venue must retain the relevant public liability insurance and/or licences as appropriate,
  4. The event holder must have the relevant permissions to hold such an event from venue owner/occupier or local authority if required,
  5. The MyPudsey Committee must consider that the event activity is legal and non-discriminatory,
  6. The MyPudsey Committee must reasonably believe that in publishing the event details, the venue will not be rendered inappropriate for potential attendees or become a health & safety concern,
  7. The event details must be accurate, reliable and must not be considered a false publication. The event holder must have a reasonably high expectation that the event will go ahead as submitted

The MyPudsey Committee reserve the right to remove any listing at any time should a breach of our terms be made known to us.

All care has been taken to be inclusive as possible.  We have also considered these terms to be effective in allowing the events listings to be manageable, deemed safe to attend and to best serve the Pudsey residents and visitors in Pudsey. The Committee cannot be held responsible for any incidents, injury, illegal activity that occur at published events or for inaccurate event details published by the event holder.

Contribution License

By submitting a Contribution to our Site, you automatically grant, represent and warrant that you have the right to grant to us an unrestricted, irrevocable, non-exclusive, royalty-free right and license to host, use, reproduce and distribute your Contribution. The use and distribution of your Contribution may occur in any format and through any of Our media channels.

We do not assert any ownership or copyright over your Contributions. You retain full ownership of your Contributions and your intellectual property rights. You are solely responsible for any Contributions to our Site and by submitting your Contribution you agree to exonerate us from all responsibility and to refrain from any legal action against us regarding your Contributions.

We reserve the right:

  1. To edit, redact or otherwise change your Contribution
  2. To decide the placement of your Contribution, including categorisation
  3. To pre-assess or delete any Contributions at any time and for any reason, without prior notice.

Third-party websites

Our Site may contain links to other websites (Third Party Websites) as well as articles, photographs, text, graphics, pictures, designs, audio, video or otherwise belonging to Third Parties. Any Third Party Website used by us on the Site is not checked or monitored for accuracy or completeness by us and we therefore cannot be held responsible for any content accessed through Third Party Websites.

When visiting Third Party Websites we strongly recommend all Users read any applicable Privacy Policies / Terms and Conditions.

Website management

We reserve the right, but not obligation to:

  1. Monitor and investigate the Site for any violations of these Terms and Conditions
  2. Take appropriate action (including legal action) against any person / business who in our opinion violates the law or these Terms and Conditions.
  3. Report illegal activity or use to law enforcement.
  4. Suspend and disable access for any User found to be in violation of these Terms and Conditions

Your Privacy

We care deeply about the privacy and security of our Users. The Site operates a separate Privacy Policy that forms part of these Terms and Conditions. By using the Site, you agree to be bound by the above Privacy Policy. All Site content is hosted within the United Kingdom, if you are accessing the Site from any other region with its own laws governing data collection that differ to those within the United Kingdom, you agree to have your data transferred to and processed within the United Kingdom.

Termination

These Terms and Conditions shall remain in force and effect the duration of your visit to our Site. We reserve the right and without notice or liability to deny access and use of our Site (including the blocking of IP addresses) to any person or business without prior reason. 

If your access is terminated for any reason, you are prohibited from using software or other tools to attempt to circumvent our restrictions, We reserve the right to take legal action, including civil action where we feel any User is in violation of these Terms and Conditions.

Modifications

We reserve the right to change, modify, remove or add to the content of our Site at any time without prior notice. We have no obligation to provide further updates to our Site content.

We also reserve the right to discontinue all or part of the Site without prior notice. We cannot be held liable for any modification, change, suspension or discontinuation of our Site.

Although we make every effort to ensure the website is continually available, we cannot guarantee that it will be available at all times. We may experience hardware, software, network or other issues. We may also from time to time need to take the website offline to carry out maintenance and improvement work.

Governing Law

These Terms and Conditions are governed by the laws of the United Kingdom. By using MyPudsey you agree to submit to the non-exclusive jurisdiction of the courts of the United Kingdom.

Corrections

Content on the Site may contain typographical errors or  inaccuracies. We reserve the right to correct any errors or inaccuracies at any time without prior notice.

Limitations

In no event will we or our volunteers be liable to you or any third party for any direct or indirect damages including lost profit, lost revenue, loss of data or other damages arising from your use of our Site.

Indemnification

You agree to defend, indemnify and hold us harmless, including our volunteers against any loss, damage, liability, claim or demand including legal fees and expenses made by any third party arising out of:

  1. Your Contributions
  2. Your use of the Site
  3. Breach of these Terms and Conditions
